Select Board Votes to Release Brick Kiln Opinion
Falmouth's Select Board voted unanimously to release a disputed legal opinion threatening the town's police station and sewer lift station plans.
Select Board · Meeting of October 9, 2026
Falmouth's Select Board voted unanimously to release a disputed legal opinion threatening the town's police station and sewer lift station plans. Town Manager Renshaw said outside counsel's October 2 opinion on Article 97 and Chapter 293 conflicts with town counsel's earlier advice on the 100 Brick Kiln Road parcel. Roughly $2.58 million of a $5.15 million police station design budget has already been spent, while a $16.7 million lift station contract continues toward a $60 million sewer project.
Resident Richard Duby said the town has spent "over $6 million" at risk; member Douglas Brown countered the true site-specific loss is closer to $194,615. Members Robert Mascali, Elizabeth Klein and Colin Reed reached consensus to prioritize alternative police station sites while keeping lift station construction moving, with Chair Heather Goldstone calling it "a pretty solid consensus."
