Zoning Board of Appeals · Meeting of October 1, 2026

FALMOUTH — The Falmouth Zoning Board of Appeals voted unanimously to grant a comprehensive permit for a 36-unit rental development at 809 Sandwich Road. Chair Susanne Murphy led the board through findings, conditions and nine waiver requests for the Falmouth Residential LLC project, which includes 11 affordable units at 80 to 110 percent of area median income and a $150,000 sidewalk contribution now tied to the permit's three-year term. The board denied four waivers that would have let the applicant bypass Department of Public Works and other town-department review, voting 5-0 against one covering street-opening permits.

Separately, the board continued a 40B hearing for a neighboring zero Sandwich Road project to November 5 after its peer engineer said an adequacy assessment could not be made without a missing stormwater management report. Associate Anthony P. Petrucci pressed hardest on that gap; the developer's attorney argued stormwater compliance is "not within the Board's jurisdiction" to review in detail.
