Zoning Board of Appeals · Meeting of September 10, 2026
Falmouth's Zoning Board of Appeals closed the public hearing on a 40B housing project at 809 Sandwich Road over the applicant's attorney's objection. The board voted unanimously to close, with member Frank Duffy moving and associate Tony Petrucci seconding, after Town Counsel George Pucci said he could get clarification from the town engineer administratively even after closing. Attorney Peter Freeman called that improper and said he would have to discuss it with applicant Jack Dolly, who stated he would not continue the hearing.
Abutters including Keith Luris and Peter Dawson warned that four access points near DaCosta Circle, combined with two neighboring projects, created what Luris called "a dangerous situation to pretend otherwise." The applicant offered a conditional contribution, roughly $150,000 to $165,000, toward an estimated $500,000 sidewalk if the adjacent Zero Sandwich Road project proceeds. The board also continued a 12-unit Broken Bow Lane hearing to October 22 and set 809 Sandwich Road deliberations for October 1.
